Get it wrong, and we cut off oxygen to growth. Get it right and watch the innovation thrive. As today’s Forbes Magazine points out, DISH Network’s play for Clearwire likely will have a bigger impact on the end-game than any government action. Still, assuming foreign ownership and security issues in a CFIUS review don’t stop the Softbank transaction, the FCC would be wise to take a hands-on approach to make sure that

(a) Sprint is required to built out its licenses quickly and put them to use, the way other wireless companies in a similar posture have been required to do, and

(b) Clearwire’s spectrum holdings aren’t hoarded in a way that forecloses competition rather than enhancing it.

Consumers only have real leverage over the companies that serve them when those companies are asking the government for something. Now is just such a time.

The statute sunsets at the end of 2014, so Congress must complete a reauthorization over the next two years. This is the only “must pass” legislation in technology and telecommunications for the 113th Congress. House and Senate committee staffers (Judiciary, Commerce) already are starting to meet with stakeholders. We should expect hearings to begin the first half of 2013. When I worked on the reauthorization last time around, key staff started the process by telling us, “this will be a narrow bill aimed only at reauthorizing the statute.” Today, we hear House Energy and Commerce Committee leadership saying, “everything is on the table.” This has telecommunications, technology, and media interests sharpening their pencils and writing their wish lists for all the Christmas tree ornaments that might be hung from the branches of STELA 2014. May we live in interesting times.

The Solar Energy Industry Association (SEIA) fought to renew the ITC in 2008. But much of SEIA’s support stems from their utility company members’ desire for industrial scale solar power plants, not distributed solar. We need public policy that is sustainable over the long term and focused directly at residences, not utilities. Perhaps the new chairman of the Senate Energy Committee, Sen. Ron Wyden (D-OR), will apply the same enthusiasm for empowering the end-user in energy that he did to empowering the end-user in technology, from his support of an Open Internet regime to his opposition to heavy-handed online copyright infringement statutes.
